Portugal Article 92 Residence Permit for Vocational Students (FAQ)

𝐖𝐞 𝐟𝐨𝐫𝐦𝐚𝐥𝐥𝐲 𝐫𝐞𝐪𝐮𝐞𝐬𝐭 𝐭𝐡𝐞 𝐫𝐞𝐬𝐨𝐥𝐮𝐭𝐢𝐨𝐧 𝐨𝐟 𝐦𝐲 𝐥𝐨𝐧𝐠-𝐝𝐞𝐥𝐚𝐲𝐞𝐝 𝐫𝐞𝐬𝐢𝐝𝐞𝐧𝐜𝐞 𝐩𝐞𝐫𝐦𝐢𝐭 𝐚𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧, 𝐰𝐡𝐢𝐜𝐡 𝐀𝐈𝐌𝐀 𝐡𝐞𝐥𝐝 𝐝𝐮𝐞 𝐭𝐨 𝐚𝐧 𝐒𝐈𝐒 𝐚𝐥𝐞𝐫𝐭 𝐟𝐫𝐨𝐦 𝐀𝐮𝐬𝐭𝐫𝐢𝐚. 𝐖𝐞 𝐰𝐚𝐧𝐭 𝐭𝐨 𝐜𝐥𝐚𝐫𝐢𝐟𝐲 𝐭𝐡𝐚𝐭 𝐭𝐡𝐞 𝐒𝐈𝐒 𝐚𝐥𝐞𝐫𝐭 𝐢𝐬 𝐚 𝐧𝐨𝐧-𝐜𝐫𝐢𝐦𝐢𝐧𝐚𝐥 𝐨𝐟𝐟𝐞𝐧𝐜𝐞. 𝐔𝐧𝐝𝐞𝐫 𝐄𝐮𝐫𝐨𝐩𝐞𝐚𝐧 𝐚𝐧𝐝 𝐏𝐨𝐫𝐭𝐮𝐠𝐮𝐞𝐬𝐞 𝐥𝐚𝐰, 𝐈 𝐜𝐚𝐧 𝐛𝐞 𝐜𝐨𝐧𝐬𝐢𝐝𝐞𝐫𝐞𝐝 𝐟𝐨𝐫 𝐚 𝐫𝐞𝐬𝐢𝐝𝐞𝐧𝐜𝐞 𝐩𝐞𝐫𝐦𝐢𝐭 𝐢𝐦𝐦𝐞𝐝𝐢𝐚𝐭𝐞𝐥𝐲.

𝟏. 𝐒𝐈𝐒 𝐑𝐞𝐠𝐮𝐥𝐚𝐭𝐢𝐨𝐧 (𝐄𝐔) 𝟐𝟎𝟏𝟖/𝟏𝟖𝟔𝟎 – 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟗, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐:

 This provision states that when a Member State considers granting or extending a residence permit or long-stay visa to a third-country national subject to an SIS alert on return entered by another Member State without an entry ban, the granting Member State must inform the issuing Member State.

 The issuing Member State must delete the alert immediately upon receiving notification.

 Therefore, AIMA is legally required to contact Austrian or any other state SIS authorities and request the immediate removal of my alert, allowing my residence permit application to proceed.

𝟐. 𝐏𝐨𝐫𝐭𝐮𝐠𝐮𝐞𝐬𝐞 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐋𝐚𝐰 – 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟖𝟖, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐 𝐨𝐟 𝐭𝐡𝐞 𝐀𝐥𝐢𝐞𝐧𝐬 𝐀𝐜𝐭, 𝐢𝐧 𝐜𝐨𝐧𝐣𝐮𝐧𝐜𝐭𝐢𝐨𝐧 𝐰𝐢𝐭𝐡 𝐀𝐫𝐭𝐢𝐜𝐥𝐞𝐬 𝟓𝟏, 𝟓𝟑, 𝐚𝐧𝐝 𝟓𝟒 𝐨𝐟 𝐑𝐞𝐠𝐮𝐥𝐚𝐭𝐨𝐫𝐲 𝐃𝐞𝐜𝐫𝐞𝐞 𝐍𝐨. 𝟖𝟒/𝟎𝟕 𝐨𝐟 𝟎𝟓/𝟏𝟏, 𝐚𝐬 𝐀𝐦𝐞𝐧𝐝𝐞𝐝:

 Portuguese law explicitly allows foreign nationals legally residing and working in Portugal to apply for a residence permit under the "Visto de Dispensa de Residência" (waiver program).

 We reside and work in Portugal, actively contributing to the country’s economy and fulfilling my social security obligations.

 Our employment in Portugal serves national interests, further strengthening my eligibility for a residence permit under Portuguese law.

𝟑. 𝐒𝐈𝐒 𝐑𝐞𝐠𝐮𝐥𝐚𝐭𝐢𝐨𝐧 – 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟑 & 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟗, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐:

 While Member States register alerts for third-country nationals subject to a return decision, exceptions exist under Article 9, Paragraph 2.

 Since Austria has not imposed an entry ban on me, Portugal has the legal right to grant me a residence permit.

 Therefore, the SIS alert should be immediately deleted according to EU law.

4. 𝐏𝐨𝐫𝐭𝐮𝐠𝐮𝐞𝐬𝐞 𝐈𝐦𝐦𝐢𝐠𝐫𝐚𝐭𝐢𝐨𝐧 𝐀𝐜𝐭 – 𝐋𝐚𝐰 𝐍𝐨. 𝟐𝟑/𝟐𝟎𝟎𝟕, 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟏𝟐𝟐, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟏(𝐝):

 This law provides that a residence permit may be granted on humanitarian grounds, including cases where an individual has significant ties to Portugal, such as employment and social contributions.

 Our contributions to the Portuguese economy and my established life in Portugal strengthen my claim under this provision.

𝐄𝐔 𝐂𝐡𝐚𝐫𝐭𝐞𝐫 𝐨𝐟 𝐅𝐮𝐧𝐝𝐚𝐦𝐞𝐧𝐭𝐚𝐥 𝐑𝐢𝐠𝐡𝐭𝐬 – 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟒𝟓 (𝐅𝐫𝐞𝐞𝐝𝐨𝐦 𝐨𝐟 𝐌𝐨𝐯𝐞𝐦𝐞𝐧𝐭 𝐚𝐧𝐝 𝐑𝐞𝐬𝐢𝐝𝐞𝐧𝐜𝐞):

 The European Union protects individuals' rights to move and reside freely within the Member States.

 Any unnecessary restriction based on an SIS alert, which does not involve a criminal offence or an entry ban, violates my fundamental right to reside in Portugal.

𝟔. 𝐈𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐂𝐨𝐯𝐞𝐧𝐚𝐧𝐭 𝐨𝐧 𝐂𝐢𝐯𝐢𝐥 𝐚𝐧𝐝 𝐏𝐨𝐥𝐢𝐭𝐢𝐜𝐚𝐥 𝐑𝐢𝐠𝐡𝐭𝐬 (𝐈𝐂𝐂𝐏𝐑) – 𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟏𝟐:

 This treaty, to which Portugal is a signatory, states that everyone lawfully within a State's territory has the right to liberty of movement and freedom to choose their residence.

 Our lawful stay and employment in Portugal further affirm my eligibility for a residence permit.

𝟕. 𝐎𝐮𝐫 𝐏𝐫𝐢𝐨𝐫 𝐋𝐞𝐠𝐚𝐥 𝐒𝐭𝐚𝐲 𝐢𝐧 𝐇𝐮𝐧𝐠𝐚𝐫𝐲 𝐨𝐫 𝐚𝐧𝐲 𝐨𝐭𝐡𝐞𝐫 𝐬𝐭𝐚𝐭𝐞 & 𝐂𝐨𝐦𝐩𝐥𝐢𝐚𝐧𝐜𝐞 𝐰𝐢𝐭𝐡 𝐀𝐮𝐬𝐭𝐫𝐢𝐚𝐧 𝐈𝐦𝐦𝐢𝐠𝐫𝐚𝐭𝐢𝐨𝐧 𝐋𝐚𝐰𝐬:

 We previously resided in Hungary with a valid visa, ensuring my legal status within the Schengen Area.

 Our legal compliance further supports the argument that the SIS alert should not hinder my residence permit in Portugal.

𝐂𝐨𝐧𝐬𝐢𝐝𝐞𝐫𝐢𝐧𝐠 𝐭𝐡𝐞 𝐥𝐞𝐠𝐚𝐥 𝐟𝐫𝐚𝐦𝐞𝐰𝐨𝐫𝐤 𝐨𝐮𝐭𝐥𝐢𝐧𝐞𝐝 𝐚𝐛𝐨𝐯𝐞, 𝐖𝐞 𝐫𝐞𝐬𝐩𝐞𝐜𝐭𝐟𝐮𝐥𝐥𝐲 𝐫𝐞𝐪𝐮𝐞𝐬𝐭 𝐀𝐈𝐌𝐀 𝐭𝐨:

 Immediately communicate with the Austrian SIS authorities to remove the alert on my name.

 Please process and approve my residence permit application without further delay according to Portuguese and European Union law.

 Provide a written confirmation of the actions taken to resolve this matter.
