 ARTICLE 123-A – RESIDENCE PERMIT Branch of the COMPANIES ESTABLISHED IN A STATE OF THE EUROPEAN ECONOMIC AREA

If you have a company in any of the EU/EEA countries and a residence card of the same country, you can apply for a residency card by opening a branch office in Portugal based on Article 123-A.

Following would be the steps & checklist.

STEP-1

Establish a company’s Head Office or Secondary Office

In Portugal, we must establish a company’s head office or secondary office with a Main Office or Secondary Office in any of the EU/EEA countries. This will work if the applicant holds a valid residence permit or residence title in the State Party to the European Economic Area or any other to be defined. Such is issued the identical residence title valid in the national territory.

STEP-2

Book an appointment with SEF for the submission & biometric

Book an appointment with (SEF) by telephone as per your connivance time and date, along with the location subject to availability. At the same time, the appointment request must explain the reason for the appointment with your details of identification and company.

ELIGIBILITY CHECKLIST

• Holder of a residence permit or card valid in the State which is Party to the European Economic Area or of the State defined/to be determined under number 1 of article 123-A, where the company was established

• The Company’s updated Commercial Registry Certification

• A Contract of Employment or services or document proving the holder of the company or social institution

• Evidence of registration within social security

Checklist for Biometrics:

• Passport

• Address proof (Junta)

• Salary Slips & Company Documents

• Permission for SEF to check Portuguese criminal

• Criminal Record of the country of the previous residence
